Risk and Liability

Your safety is of our upmost concern.

A Boat Day LLC, its owners, employee’s and insurer will not be responsible for any injuries to any person(s) that may occur while entering the water or exiting the water when a pier or dock is not available, such as anchoring just off a beach shore.

This also includes any injuries to any person(s) that could occur while off the vessel while swimming, snorkeling or shelling. You should be in good health & free from high blood pressure, heart, neck or back problems, leg, knee or hip problems, motion sickness, vertigo or other conditions that could be aggravated by this activity. If you are in doubt of your health please contact your physician.

All passengers will be required to sign a liability waiver prior to arrival. Waivers will be sent in confirmation emails and must be signed prior to participating in any of our activities. Click here to view our waiver.

For groups over six passengers, in order to comply with U.S. Coast Guard regulations, we require a Bareboat Charter Agreement.  As part of that Agreement, the following applies: Charterer understands that the Owner does not require Charterer to hire a captain from the Owners provided list of Captains to operate the Vessel.

However for the safety of the passengers and public, and care of the Vessel, the Owner requires that the operator of the vessel, or skipper brought or hired by Charterer, be a qualified and competent person who holds a valid U.S. Coast Guard issued OUPV or Master level license and shall be responsible for the safe navigation of the Vessel.
